FixChurn™ Terms and Conditions

1. Ownership and Acceptance of Terms

FixChurn is a software service and brand operated by Honest Matters LLC. By accessing or using the FixChurn™ website or platform, you agree to these Terms and Conditions (“Terms”). If you do not agree with these Terms, you must not use the Service.

2. Description of Service

FixChurn™ is a data-driven analytics and automation platform for Skool community owners. It helps identify at-risk members and suggest actions to improve retention. The service is provided as-is and without warranty.

3. Eligibility and User Responsibilities

You must be at least 18 years old to use FixChurn™. You agree to provide accurate information and are responsible for securing your account access.

4. Subscription, Billing, and Cancellation

FixChurn™ operates on a subscription basis. Billing occurs monthly or annually in advance.

We require 30 days’ written notice for cancellation. Failure to provide notice may result in an additional month’s charge to cover offboarding and technical costs. No partial refunds will be issued.

5. No Guarantee of Outcomes

FixChurn™ provides data-based insights and engagement recommendations, but does not guarantee reduced churn, revenue increases, or user outcomes.

Decisions based on FixChurn™ insights are the sole responsibility of the user. Use of the Service is at your own risk.

6. Privacy, Data Use, and Third-Party Services

FixChurn™ uses third-party services such as Airtable, Render, and Skool.

While we use secure platforms, we are not responsible for security breaches, data loss, or service outages on those platforms.

FixChurn™ does not sell or share your data with any third party outside what is required to deliver our service.

7. Security and Data Breach Limitations

While FixChurn™ implements security best practices, we cannot guarantee immunity from breaches or attacks.

Honest Matters LLC disclaims liability for data loss or exposure resulting from malicious actions or third-party platform failures.

8. Intellectual Property

All content, code, and materials associated with FixChurn™ are owned by Honest Matters LLC. You may not copy, distribute, or reverse-engineer any part of the Service.

9. Acceptable Use

You agree not to misuse the Service, interfere with its operations, attempt unauthorized access, or use FixChurn™ in violation of applicable laws.

10. Termination

FixChurn™ may suspend or terminate your access for violating these Terms. You may cancel anytime with 30 days’ notice.

11. Force Majeure

FixChurn™ is not responsible for delays or failure to perform due to events beyond our control, including but not limited to natural disasters, internet outages, or provider failures.

12. Limitation of Liability

FixChurn™ and Honest Matters LLC are not liable for indirect, incidental, or consequential damages, or for lost revenue, data, or business opportunities resulting from your use of the Service.

13. Dispute Resolution and Mediation

All disputes will be resolved through mediation, prior to any legal proceedings.

The mediator will be selected by FixChurn™ and Honest Matters LLC.

14. Cookies and Tracking

The FixChurn™ website may use cookies and tracking tools to improve user experience. By using the website, you consent to such usage. See our Privacy Policy for more details.

15. Copyright and DMCA Policy

FixChurn™ respects intellectual property rights. If you believe your copyrighted work is being used improperly, contact us with appropriate DMCA documentation to request removal.

16. GDPR Compliance and Data Processing

This section serves as our Data Processing Addendum (DPA) for users in the EEA, UK, and Switzerland.FixChurn acts as a Processor, the Customer is the Controller. We agree to:

17. Future Features and Affiliate Terms

FixChurn™ reserves the right to update these Terms. All changes will be posted on our website and timestamped. Continued use of the Service after updates constitutes acceptance.
